Heard.

Perused the reply of the prosecution and the case diary.

Although it is stated in paragraph 5 of the reply that this applicant was not only present at the scene of crime, but was also playing an active role by provoking other accused persons to cause damaged to the M.S.R.T.C. Bus, I could not come across any material present in the case diary to substantiate this allegation. There is not a single witness pointed out by the learned A.P.P. to me who has stated that this applicant provoked the other co-accused.

In view of the above, I find that this is a fit case for grant of confirmed anticipatory bail. The application is allowed and the interim anticipatory bail granted to the applicant by this Court on 12th April, 2018 is hereby confirmed on the same conditions.

The application is disposed of in the above terms.
