The petitioner - Association of parents of children, then taking education in an un-aided private C.B.S.E. Secondary School, question fee determination in the Academic Years 2004-05 and 2006-07, in these two petitions.

We have heard Shri S.K. Pardhy, learned counsel for the petitioners in both matters, Shri S.S. Ghate, learned counsel for the concerned School and Mrs. M.P. Munshi, learned counsel for the Union of India.

During hearing, we find that this Court did not grant any interim relief and hence the students parted with fees as determined and thereafter have also passed out of the School.

The grievance, therefore, is rendered only academic. Hence, keeping contentions open, we dispose of present petitions as infructuous. Rule discharged. No costs. JUDGE JUDGE *GS.
