The applicant herein is seeking recall of order dated 28/08/2020, whereby application for anticipatory bail filed by Anupama Pankaj Khandekar, was allowed by this Court by a detailed order. It is submitted in these applications that when the said order was passed, it was not brought to the notice of this Court that the application to assist the prosecution had been filed on behalf of the original complainant. Mr. Anup Dhore, learned counsel appearing for the original complainant submitted that on this basis order dated 28/08/2020, needs to be recalled.

This Court has heard Mr. Dhore appearing for the original complainant on the question as to why the order dated 28/08/2020, ought not to have been passed.

Having heard the learned counsel, this Court is of the opinion that no new or different aspect could be highlighted by the counsel from what was already placed before this Court by the learned APP on behalf of the State. Consequently, this Court finds no reason to take a different view in the matter and it is found that no sustainable ground is made out for recall of the order dated 28/08/2020.

In view of the above, application bearing Criminal Application (APPP) No. 736/2020 is dismissed and order dated 28/08/2020, passed by this Court in Criminal Application (ABA) No. 283 of 2020 is maintained.
