The applicant is facing trial for offence punishable under sections 395, 365, 342, 385 of the Indian Penal Code.

In view of the liberty sought to withdraw the application, it would not be appropriate to make any observation on merits of the prosecution case. However, the submission is that if there is no significant progress in the trial the applicant may be given liberty to apply for bail afresh. The submission is reasonable. The application is disposed of as withdrawn with liberty to the applicant to apply for regular bail if there is no significant progress in the trial for six months. JUDGE NSN
