Shri S.R. Deshpande, learned Advocate appearing for respondent No.3 raised objection that the petition should not be entertained as the petitioners have alternate statutory remedy under Section 111 of the Maharashtra Tenancy and Agricultural Lands (Vidarbha Region) Act, 1958.

In view of the above objection, learned Advocate for the petitioners seeks permission to withdraw the writ petition with liberty to avail alternate statutory remedy. Writ petition is disposed as withdrawn with liberty as prayed for. No costs.

If the petitioners approach the Maharashtra Revenue Tribunal within one month from today, considering the fact that this petition had been pending since April 2017, Tribunal shall consider the prayer of petitioners for condonation of delay liberally. JUDGE Tambaskar.
