Heard learned counsel for the rival parties. Perused the record.

Undoubtedly, even according to the applicant, he is not the owner of the property, which was agreed to be sold. Learned counsel for the applicant disputes the execution of agreement on the ground that the signature was obtained on blank stamp papers and the applicant did not receive any cash as stated in the agreement. In view of the fact that the applicant admits that he is not owner of the suit property, which was agreed to be sold by him, I think the applicant has, prima facie, committed the offence in question. The submission about agreement etc. are all the matters of investigation, which cannot be looked into at this stage.

That being so, I make the following order.

ORDER

(i) Criminal Application No.224/2015 is rejected. JUDGE kahale
