The grievance of the petitioner No.2-College run by the respondent No.1Educational Society, is that it has been sanctioned 120 students for the Science Stream since the year 2020-21. It is the further grievance of the petitioners that the respondent No.5-College has been undertaking the admission of more students than the figure of students that was sanctioned by the respondent Nos.2 to 4. The petitioners therefore pray that the respondent Nos.2 to 4 should ensure fair and uniform distribution of admission to the Colleges from the Academic Session 2023-24 and onwards.

In the affidavit-in-reply filed by the respondent No.5, reference is made to the Government Resolution dated 10-11-2022 issued by the School Education and Sports Department stating therein that only in the Academic Session 2022-23 for the Districts Chandrapur and Gadchiroli, excess admissions beyond 120 students were being regularized as a special case. 4.

The learned Additional Government Pleader for the respondent Nos.1 to 3 has tendered the communication dated 30-8-2023 that has been issued by the Deputy Director of Education, Nagpur Division, Nagpur. The same is taken on record and marked '

A' for identification. As per the said communication, the respondent No.5 has been put to notice that it should not admit students exceeding the sanctioned capacity. It has been further stated that the action would be taken if excess students have been admitted.

In view of the aforesaid communication dated 30-8-2023, the purpose of filing the writ petition is served. The respondent Nos.2 to 4 shall act in accordance with the said communication and take further steps, if found necessary.
