Heard the learned counsel for the parties.

Perused the contents of the application. Also, considered the orders passed by the Courts in several proceedings instituted by the parties against each other. In the circumstances of the case and on a consideration of the monthly income of the applicant, the non-applicant and also the dependency, the prayer made in the application is partly granted.

The non-applicant-appellant is directed to pay a sum of Rs.5,000/- per month to the applicant, during the pendency of appeal. The non-applicant-appellant should pay a sum of Rs.5,000/- to the applicant towards litigation expenses within a period of one month.

The civil application is allowed in the aforesaid terms and disposed of.
