The applicant is facing trial for offence punishable under sections 457, 380 and 511 of the Indian Penal Code in Criminal Case 101/2007 pending before the Judicial Magistrate First Class, Chimur.

During the course of the trial, the applicant allegedly absconded and did not appear before the court with the result that the trial came to a stand still for more than ten years. The applicant is arrested pursuant to a non-bailable warrant issued by the Trial Court. The learned Trial Court and the Additional Sessions Judge, Warora both have refused to exercise discretion in favour of the applicant.

I do not find any infirmity in the view taken by the learned Magistrate and the learned Sessions Judge. The conduct of the applicant clearly disentitles him to grant of bail.

ba405.18.O.odt 2 However, the trial needs to be expedited. The learned Magistrate is requested to conclude the trial within a period of three months from communication of this order.

With this direction, the application is disposed of.
