Heard learned counsel appearing for the parties. The learned counsel appearing for Respondent No.3 states that the challenge made by the petitioner to Recovery Certificate dated 22nd February, 1999 does not survive as the Respondent No.3 is not desirous of acting upon the said certificate.

Arguable questions are raised.

Liberty to apply for early date of hearing after pleadings are completed."

The aforesaid order was passed after hearing the learned counsel for the petitioner, and the learned counsels for the respondent Nos.1, 2, 3, 4 and 6.

In view of the statement made by the respondent No.3 before this Court, which has been recorded, the challenge to the
