Learned Advocate for the petitioner is absent. 2.

Present petition was filed for direction to respondent no.1 to conduct inquiry against Bit Jamadar, Dhule Taluka Police Station, Dhule for submitting report on the furlough leave application filed by the petitioner.

Learned APP submits communication by the Superintendent, Open Prison, Paithan, and states that the petitioner has been released permanently. In view of the undergoing entire sentence by order dated 20-07-2023 by the Government, under the said circumstance, practically the petition has become infructuous. So also taking into consideration the prayer, if at all, there is any right to the petitioner, he may exhaust it separately and not through the constitutional powers of this Court.
