DATE : 07.11.2025 By this application, the applicant is seeking condonation of delay 1700 days in filing the crossobjection. Admittedly, the first appeal filed by acquiring body is admitted by this Court on 30.07.2018. The same is pending for final disposal.

The applicant states that as per the judgment of reference Court, he received the compensation amount in the month of February 2025. Before that he was not in Prity
2 / 2 7.cao1194.2025 sound financial position to take necessary steps to file the cross-objection.

The learned counsel for the respondent strongly opposed this application. According to him, the reasons stated in the application are not sufficient to condone the delay. The delay is of 1700 days and therefore, this Court should not allow the application for the reasons stated in the application.

In the circumstances, by keeping the point open as to whether the cross objector will be entitled for interest for the period of delayed in case the cross objection is allowed, the delay of 1700 days in filing the cross objection is allowed.
Cross - Objection (St) No. 8615/2025 Heard.

The filing of private paper-book is dispensed with. In view of the fact that the paper-book is already filed in First Appeal No.1109/2016.
