Rule. Shri R.J. Mirza, learned counsel, waives service of notice for the respondents.

The challenge raised in this writ petition is to the show cause notice dated 18-4-2023 issued by the respondents calling upon the petitioner to show cause why its name should not be put in the black-list. The petitioner has been granted time of three days to file its reply. According to the petitioner, such reply has been filed on 19-4-2023.

Since the show cause notice has been issued to the petitioner to which its response has been called for and as it is stated that such reply has been filed, we find that the interest of justice would be served by passing the following order : 4.
The respondent-Municipal Council shall consider the reply filed by the petitioner to the show cause notice dated 18-4-2023 in accordance with law and after giving an opportunity to the petitioner, it shall pass appropriate orders on the said show cause notice. In case any adverse order is passed on the said show cause notice, the same shall not be given effect to for a period of seven days from the date of communication of such order. 5.
Keeping the points raised in the writ petition open, the writ petition is disposed of. Rule accordingly. No costs.
