Criminal writ petition is dismissed in default since the petitioner did not supply copy of petition for service on respondents.

Seen the averments in the application. Since the respondents 2 and 3 were not served when the petition was dismissed, it is not necessary to issue notices to respondents 2 and 3 on the application for condonation of delay. Subject to payment of costs of Rs.500/- to be deposited with the Vidarbha Lady Lawyers Association, Nagpur, application for condonation of delay is allowed. Criminal Application (APPW) No.95/2018:

For reasons recorded while allowing the application for condonation of delay, the application for

appp692.18.O.odt 2 restoration is allowed. However, the restoration is subject to the condition that the learned counsel shall supply copies for service on respondents within 48 hours. Needless to say, if the copies are not supplied in the stipulated period the order of restoration shall stand revoked.
