Heard learned counsel Ms S.S.Jadhav for the applicant and learned Additional Public Prosecutor Ms T.H.Udeshi for the State.

Learned counsel for the applicant fairly submits that earlier application of the applicant has already been decided on merits by the Court on 6.12.2019. She also fairly submits that after rejection of the application of the applicant on merits, since trial was not commencing, she preferred an application for bail which was rejected and, therefore, this application is filed. Further, it is her fair statement that during pendency of this application, trial has already commenced and recording of evidence has already started. 3.

In this view of the matter, in my view, the case of the applicant need not be considered afresh when earlier application of the applicant for grant of bail was already .....2/-

At this stage, learned counsel for the applicant submits that she be permitted to withdraw the application. The permission is granted to learned counsel for the applicant as prayed for.

The criminal application is rejected and disposed of as withdrawn.
