Heard Shri P.A.Abhyankar, advocate for the applicant/ appellant and Shri N.S.Khubalkar, A.P.P. for the non-applicant/ respondent.
Though the application is opposed by the learned A.P.P., considering the fact that in the departmental enquiry the appellant is exonerated and considering the quantum of sentence imposed on the appellant and the fact that the appeal will not be heard in near-future and the appellant was on bail during the trial and nothing adverse is reported against him, the effect and operation of the judgment is stayed and the sentence imposed on the appellant is suspended.
The appellant be released on bail on the same terms and conditions as before the Special Court. The criminal application is allowed in the above terms.
