None appeared on behalf of the petitioner. This petition is filed in September, 2020 challenging the judgment dated 08.03.2017. By the judgment impugned, the marriage between the petitioner and respondent is dissolved by mutual consent.

The petitioner has also preferred Civil Application 2026 of 2021 seeking permission to withdraw the petition with liberty to file fresh petition.

In paragraph 3, the avernment that there are several mistakes in the pleadings, the dates, the documents annexed and the prayer clauses.

I note, this petition appears to have been instituted belatedly.

In this view of the matter, while I am permitting

2 12 wp 5261 the petitioner to withdraw the petition with liberty to institute fresh petition, it is made clear that the issue of delay and latches is kept open and this permission and liberty shall not be construed as an exemption or condonation of delay. 7.

The subject what is observed supra, the petition is disposed of as withdrawn.
