Ms. Gaiki, learned A.P.P. appearing on behalf of respondent State also submits that as appellant has expired way back in the year 2009, the appeal abates.

Shri Mohod, learned counsel has tendered a postal envelope sent by Advocate Gaikwad to the appellant, which is received back with endorsement by

Order 1005apeal200.07 (2) postman. Said endorsement dated 09.03.2018 mentions that the appellant Ashok Vithalrao Gahukar, has expired.
