DATE : 04.12.2025 The present application is preferred by the applicant for quashing of the FIR and consequent proceedings arising out of the same bearing Crime No.109/2023 registered under Section 409 of the Indian Penal Code.

The crime is registered on the basis of a report lodged by the Naib Tahsildar, on an allegation that during inspection of the fair price shop of the present applicant, it reveals to him that the applicant has not distributed food-grains, which is reserved for the poor strata of the society and committed the misappropriation of the same.

It is further alleged that the applicant has misappropriated the stock of a food-grains which was lifted on the name of the dead persons and thereby misappropriated the same.

On the basis of the said report, police have registered the crime against the present applicant. During investigation, the statements of the various witnesses are recorded and from which it reveals that prima facie case is made out against the present applicant. Therefore, we have shown our disinclination to entertain the present application at the initial stage and therefore, we have also declined to issue the notice to the non-applicants.

Considering the prima facie material against the present applicant. The application deserves to be rejected. Accordingly, we proceed to pass the following order :
