At the outset, the learned Counsel for the applicant/ appellant prays for amendment in the application to the effect of referring to the length of delay caused. He submits that inadvertently the length of delay is not reflected in the application. The oral prayer for amendment in the application is allowed.

For the reasons stated in the application, the delay is condoned. The application is allowed and disposed of accordingly.

Civil Application No.1594/2016 :- For the reasons stated in the application, the application is allowed.

On carrying out amendment, issue notice to respondent Nos.1a and 1b.

Advocate Shri Shinde, holding for Shri Bhangde, the learned Counsel, submits that Advocate Bhangde received instructions to appear on behalf of legal representatives of respondent No.1 and Advocate Bhangde waives notice for respondent 1a and 1b.
