By preferring this application, the applicant / appellant has challenged the order of conviction passed by the Sessions Court, Warora.

By order dated 06/06/2017, this Court has suspended the sentence and released the appellant on bail. As per order of this Court, he has not furnish the bail before the learned trial Court, and therefore, non-bailable warrant is issued against the present appellant. On execution of the said warrant, the appellant is produced before the Court.

Learned counsel Mr. A.C. Jaltare for the appellant submitted that due to some miscommunication, he could not furnish the bail. There was no intention to held up the matter. Now, he will furnish the bail and will abide the condition imposed by this Court.

Considering the reason mentioned by the learned counsel for the appellant, and considering the fact that, the conviction is of a limited period, the non-bailable warrant issued to the appellant deserves to be cancelled and the appellant is to be released on bail. Accordingly, I proceed to pass the following order:

ORDER

a] The appellant is released on bail on executing P.R. Bond of Rs. 25,000/- with one solvent surety of like amount.

b] The appellant shall remain present before the Additional Sessions Judge, Warora on first of every month and the Sessions Court shall record his presence. c] The criminal application is disposed of.

d] List the appeal after Summer Vacation-2024.
