Hearing was conducted through video conferencing and the learned Counsel agreed that the audio and visual quality was proper.

This is second application which ought not to have been filed and the reason is that when the earlier application was to be dismissed, the same was withdrawn and the trial Court was directed to conclude the trial within one year from the date of the order. This is recorded in the order dated 16.01.2020 (Coram: V.M.Deshpande,J) in Criminal Application (BA) 10/2020. This Court was inclined to dismiss the application with exemplary costs.

However, the learned counsel seeks leave to withdraw the application unconditionally and states that he would advise the applicant not to indulge in such sharp practice in future.

The application is dismissed.
