After hearing the learned counsel for the applicant for some time and on expressing that this Court is not inclined to allow this application, on instruction, he seeks permission to withdraw the present application. He further states that liberty may be granted to the applicant to apply a fresh application, if there is no progress in the trial, in near future.

Permission is granted to withdraw the application with liberty to apply a fresh application, in case, there is no progress in the trial, in next one year. The criminal application is disposed of as withdrawn.
