By this writ petition, the petitioner had sought a direction to the respondents to treat the services of the petitioner as continuous from 04.01.1965 for grant of pensionary benefits. Learned counsel Shri Kandhari holding for Shri A.K. De, the learned counsel for the respondent no.2, states by referring to the submissions filed on behalf of the respondent no.2 that the services of the petitioner are taken into consideration from 04.01.1965 for grant of pensionary benefits to the petitioner. It is stated that the breaks have been condoned for the purpose of grant of pensionary benefits and the petitioner was granted revised pension of Rs.2,958/- in stead of Rs.2,600/- as on the date of the filing of the submissions, 29.04.2004.

In view of the statement made on behalf of the respondent no.2, it appears that the grievance of the petitioner must have been redressed. Hence, we dispose of the writ petition with no order as to costs. Rule accordingly. JUDGE JUDGE APTE
