DATED : APRIL 22, 2019 The Education Officer has determined seniority of the petitioner under Rule 12(3) of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. The petitioner had raised certain objections, which are not decided by the Education Officer. If on the basis of such seniority list prepared, petitioner is superseded in the matter of promotion, he shall have remedy of challenging such supersession by filing an appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 in which School Tribunal can judge validity and correctness of the order passed under Rule 12(3) of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. With the above observations, the petition is disposed of. All questions are kept open.
