Shri S.S. Doifode, APP for State.

CORAM: ROHIT B. DEO, J.

DATE: 15 th June, 2018.

Heard.

The applicant is apprehending arrest in Crime 33 of 2018 registered at Police Station Talegaon for offence punishable under section 3 & 7 of the Essential Commodities Act and Section 130(1)(3) and Section 177 of the Motor Vehicles Act.

The learned counsel for the applicant states that he has cooperated with the Investigating Officer and has abided by the conditions imposed by order dated 20.4.2018. In all fairness, the statement is not disputed by the learned APP.

It is not the case of the prosecution that custodial interrogation of the applicant is necessary. The seizure of the documents is effected.

In the light of the accusations against the present applicant, the fact that he has cooperated with the Investigating Officer and custodial interrogation does not appear to be necessary, I am inclined to allow the application.

aba267of18.odt 2 The interim order dated 20.4.2018 is confirmed. The applicant shall attend Police Station Talegaon once in a month between 10.00 a.m. to 12.00 p.m. till filing of the chargesheet.

The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.
