This is an application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail in connection with Crime No.299 of 2022, registered with Police Station, Hudkeshwar, Nagpur for the offences punishable under Sections 420, 504 and 506 read with Section 34 of the Indian Penal Code.

The learned counsel for the applicant submits that the applicant is one of the co-owners of the land in question and the partners of Om Sai Housing Agency contacted family members of the applicant and got the documents executed about the land in question. It is submitted that the applicant is nowway connected with the alleged offence as he has not received any amount in relation to the alleged transaction.

The learned counsel for the applicant further submits that main accused Hiwraj Pradhan and other three co-accused have already been released on anticipatory bail, accordingly he submits that he is entitled for grant of bail on parity.

On the other hand, the learned A.P.P. opposes the present application.

From perusal of the documents filed along with this application, case diary and the F.I.R., it reveals that vide order dated 31/05/2022 passed below Exh.1 by the learned Ad-hoc District Judge-4 and Additional Sessions Judge, Nagpur in Criminal Bail Application No. 1339 of 2022, bail was granted to the co-accused Hiwraj Pradhan, Prashant Thakare, Vilas Mohad and Vilas Wankhede. The case of the applicant is not different than the case of the above referred accused who have been released on bail. 7.
The applicant has attended the Police Station on numerous occasions and there is no complaint of misuse of liberty by the applicant.

In that view of the matter, I am of the opinion that the applicant is entitled for grant of anticipatory bail on parity. Accordingly, I pass the following order: i) The application is allowed.
3 38-ABA350-2022 ii) Order dated 24/05/2022 granting ad-interim anticipatory bail to the applicant is confirmed. iii) The applicant shall attend the concerned Police Station as and when his presence is required. The Criminal Application is disposed of accordingly.
