The petitioner is aggrieved by the order passed below Exhibit 35 wherein his application filed under provisions of Order XI Rule 1 read with Rule 14 of the Code of Civil Procedure, 1908 seeking production of the measurement sheet dated 05.12.2008 has been rejected.

The consequence of not producing the document of which production was sought can be urged by the defendant while arguing the suit on merits. It is therefore not necessary to interfere at this stage. The petitioner is free to urge the effect of nonproduction of that document before the trial Court. The Writ Petition is disposed of. No costs.
