According to the learned Counsel for the petitioner the fair price shop licence of the petitioner is cancelled without issuing notice to the petitioner by the District Supply Officer. Said order is challenged by the petitioner before the Deputy Commissioner and had also filed application for stay to the order passed by the District Supply Officer. The Deputy Commissioner has not given opportunity to the petitioner while rejecting the application and said order is challenged before this Court. 3.

The order passed by this Court on 22.4.2019 is as under:- "It is submitted by the learned counsel for the petitioner by referring paragraph 12 in the writ petition that the show cause notice dated 18th March, 2019 was never received by the petitioner. It is further submitted that Naib Tehsildar did not submit the report as directed and in absence of such report, the licence issued to the petitioner has been cancelled. The Deputy Commissioner (Supply) has not considered these aspects and has rejected

2 wp3200.2019 the application for stay.

Issue notice to the respondents for final disposal of the petition, returnable on 12th June, 2019.

Ms. Kalyani Deshpande, learned Assistant Government Pleader waives notice for the respondents.

Ad-interim relief in terms of prayer clause (c).

In the meanwhile, the respondent No.2 is at liberty to proceed with the adjudication of the appeal."

In view of the order passed by this Court on 22.4.2019 the interim relief is continued till disposal of the revision by the Deputy Commissioner and direction is given to the Deputy Commissioner to dispose of the revision within a period of four weeks.

With the above observations, writ petition is disposed of. No costs.
