The petitioner No.1 came to be appointed as General Majdoor with the Western Coalfields Ltd. in the year 1990. She was subsequently promoted to the post of Peon. Under the Coal India Special Female Voluntary Retirement Scheme 2015, the petitioner No.1 nominated her son-petitioner No.2 for employment. Though a medical test of petitioner No.2 was conducted, the petitioner No.1 did not voluntarily retire and she continued in service till her age of superannuation. In the meanwhile the aforesaid scheme of 2015 has since been discontinued.

In these facts since the petitioner No.1 did not voluntarily retire from service, the relief for grant of employment to the petitioner No.2 under the said scheme cannot be granted.
