It is seen from the first information report lodged by the complainant-Shekhar Rajanti that according to him, this applicant had dealt blow of sword on his right leg. However, the injury report of the complainant discloses that he had sustained injuries in the nature of; two abrasions and one contusion, all simple in nature and caused by hard and blunt object. This creates a doubt about the role of this applicant as well his participation with criminal intention. Therefore, in my view, this applicant would be entitled to be released on bail.
Learned A.P.P. for the State has pointed out to me that there are three criminal cases registered in the past against this applicant
2/3 and, therefore, she submits that this applicant should not be released on bail.
Learned Counsel for the applicant points out from the crime chart that from out of these three criminal cases, this applicant has been cleared from two cases and only one criminal case is pending against him.
The pendency of criminal cases could have been taken into account, in my view, had there been some prima facie material against the present applicant in the present case. That being not so, I do not think that the pendency of criminal case against the applicant would be relevant in this case. Hence, the order.
The application is allowed and the interim bail granted by this Court to the applicant on 29/4/2016 is hereby confirmed on the conditions that the applicant shall attend the concerned police station on every Sunday between 5.00 p.m. and 6.00 p.m. till the charge-sheet is filed, shall cooperate with the police in the investigation of the case and shall not tamper with the prosecution evidence.
