Learned counsel for the appellants has invited my attention to the report dated 7.4.2015 submitted by the Coordinator, Mediation Centre, High Court, Nagpur in which there is a remark that mediation 'succeeded' with reference to the settlement of agreement dated 6.4.2015 filed along with the report.

I have seen the agreement in the form of settlement filed in this Second Appeal. None of the parties have objection to the settlement before me. The agreement is signed by the Mediator also. I therefore accept the mediation report as well as settlement filed before this Court, which shall form part and parcel of the judgment and decree. In the result, I make the following order:

ORDER:

Second Appeal No.265/2013 is disposed of in terms of the mediation report dated 7.4.2015 and agreement accompanying thereto duly signed by parties, respective counsel as well as the Mediator. The

No order as to costs.
