After hearing for some time since the Court was not inclined to interfere in the judgment, in light of the contents of the sale deed as no civil proceeding has been initiated in regard to the same, as the plea raised is in respect of issuance of the cheque over and above the sale consideration as mentioned in the sale deed, which entire consideration is admitted to have been received, Mr. Thakare, learned counsel for the applicant/appellant on instructions seeks to withdraw the application for grant of leave, with liberty to file appropriate civil proceedings, if permissible in law.

The statement is accepted. The application/appeal is hereby dismissed as withdrawn. It is needless to mention that in case the appellant has a right available in law to challenge the
