DATED : DECEMBER 11, 2025 1) The Party No.1 and Party No.2 i.e. appellant and respondent herein are present in person along with their respective counsels. They have arrived at a deed of compromise, which is taken on record and marked as 'X' for identification purpose.
2) It is informed that both parties have arrived at the agreement as per the terms mentioned in the deed of compromise which parties arrived at voluntarily and amicably. There are various proceedings pending before the various Courts. Both parties have agreed to withdraw the respective proceedings and the allegations made against each other.
3) In the present Family Court Appeal, the challenge is to the judgment passed in petition No.A-545/2023 as also petition No.A-384/2019. The petition No.A-545/2023 was filed by wife for decree of divorce. As the decree of divorce was not granted, she filed present Family Court Appeal. It needs to be noted here that parties have been residing separately since 2016. In view KOLHE
2 951-fca 44.2025.odt thereof, there is no question of cooling period. In view of the compromise deed, parties have agreed at passing of decree of dissolution of marriage by mutual consent.
4) In view thereof, the appeal is allowed. It is hereby declared that the marriage between Party No.1 and Party No.2 is dissolved by mutual consent. Accordingly, the decree of dissolution of marriage be drawn as per the terms mentioned in the compromise deed. The compromise deed marked as 'X' shall be the part and parcel of the decree of divorce. 5) The appeal stands disposed of in the above terms. ( M.W.CHANDWANI, J. ) ( M.S.JAWALKAR, J. ) KOLHE
