Heard learned counsel for the parties.

Learned APP is seeking time to obtain instructions. However, prayer is to restore Criminal Writ Petition No.1089 of 2014 dismissed in default on 17th of April, 2015.

Costs of Rs.1000/- as directed by said order are paid by the petitioner. The reasons for absences are supported by personal affidavit of learned counsel. As such we do not find it necessary to adjourn the matter. Order dated 17th of April, 2015 is recalled and criminal Writ Petition No.1089 of 2014 is restored back to file. Learned APP waives notice for the respondent after restoration.
