Date : 8 th February, 2016 The interim order of injunction passed by the Trial Court was operating since 2007. The appeal challenging the order of injunction lying before the lower Appellate Court was also pending along with the application for restoration of the appeal for a period of five years. The lower Appellate Court has dismissed the application for restoration of the misc. civil appeal. In the facts and circumstances of the case, I do not find any reason to interfere in the order passed by the lower Appellate Court.

The appeal is dismissed.

The suit is expedited.
