By this petition, the petitioner has challenged the order appointing the respondent no.3 on the post of Head Master, thereby superseding the claim of the petitioner to the said post.

The petitioner has an alternate efficacious remedy of filing an appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977. Instead of availing the said remedy, the petitioner has filed the writ petition.

We decline to entertain the writ petition in view of the availability of the alternate remedy. The writ petition is disposed of with no order as to costs. The points raised in the petition are, however, kept open.
