Tembhare, learned Additional Public Prosecutor waives notice for respondent-State. He tenders reply of the prosecution, which is taken on record.
On perusal of the reply and the case diary, I am of the opinion that the allegations made against applicant no. 1 are general in nature, but they are very specific against applicant no. 2. These allegations also give prima facie impression that if released on bail, applicant no. 2 is likely to misuse his liberty. Therefore, I am inclined to allow the application of applicant no. 1, but not of applicant no. 2. Application of applicant no. 2 Shyam Vinayak Shelolar stands rejected.
Application of applicant no. 1 Rajkanya Vinayak Shelokar is granted and it is directed that she be released on bail in Crime No. 49/2018 registered with Police Station, Tiosa for the offences punishable under Sections 306, 498A read with Section 34 of the Indian Penal Code on her executing PR Bond of Rs. 30,000/- together with one solvent surety, on the following conditions :
2 ba416.18 (1) Applicant no.1 shall attend the trial Court on dates of hearing as may be fixed in the matter. (2) Applicant shall cooperate with the trial Court for expeditious disposal of the trial.
(3) Applicant shall not tamper with prosecution evidence in any manner.
