We have heard this matter for some time.

Mr. S.P. Bhandarkar, learned counsel for the petitioner on instructions, submits that the petitioner would be making an application to the University for change of examination centre. He further states on instructions that the petitioner would also be making complaint /representation to the Dean of the Respondent No.6-Institution and also to the University regarding victimization of the petitioner and taking an appropriate action in the matter after conduct of due enquiry.

The proposals of the petitioner are worthy of consideration and, therefore, we grant liberty to the petitioner to make a suitable application seeking change of his examination centre

WP.2834.22 and also complaint /representation seeking enquiry into the grievances raised by the petitioner and taking of appropriate action depending upon the outcome of the enquiry.

Liberty is accordingly granted to the petitioner. In case the application for change of examination centre is made by the petitioner within two days, the same shall be decided by the respondent Nos. 4 and 5 in accordance with law at the earliest and preferably on or before 29th July, 2022. 5.

As regards the complaint proposed to be made by the petitioner, we direct that if it is made within two days from the date of this order, the same shall be decided in accordance with law after making proper enquiry by the University as well as the Dean of Respondent No.6-Institution as expeditiously as possible and preferably within eight weeks from the date of receipt of the complaint. We clarify that the scope of the consideration of the grievances raised in the complaint, insofar as the University is concerned, shall be restricted to clause 71.13 read with clause 71.13.2.2 of the Ordinance No.1/2014.

The Writ Petition is disposed of in the above terms. No costs.
