The applicant is apprehending arrest in Crime 353/2020, registered with Police Station, Kuhi, Dist. Nagpur, for offence punishable under section 376(2)n of Indian Penal Code read with sections 4 and 6 of Protection of Children from Sexual Offences Act.

Vide order dated 18.9.2020, the applicant was protected subject to the condition that he would attend the Police Station and shall give blood sample for DNA analysis. 4.

It is not the case of the prosecution that the condition of pre-arrest protection is not complied with. 5.

The complainant has filed an affidavit before the Sessions Judge withdrawing her allegations.

That apart, the investigation is complete and the chargesheet is filed, is the statement of the learned counsel for the applicant, who also has a copy of the chargesheet which is shown to the learned APP Mr. N.R. Rode. 7.

Since custodial interrogation of the applicant is not necessary, the interim protection granted vide order dated 18.9.2020 is made absolute.
