This is an application filed on behalf of respondent No.1 seeking withdrawal of amount of backwages deposited by the petitioner, in terms of order dated 04/12/2019, passed by this Court. In terms of the said order, the petitioner deposited an amount of Rs.3,98,575.00 towards 50% of backwages in this Court. In the application, it is pointed out that respondent No.1 has incurred expenses towards hospitalization and medical treatment due to serious health condition. Certain documents have also been placed on record indicating expenses incurred by applicant / respondent No.1.

A reply has been filed to the present application opposing prayer made in the present application, inter-alia, on the ground that the notice was issued by this Court for final disposal of the writ petition and writ petition itself could be disposed of finally at an early date. But, considering the fact that the respondent No.1 has indeed incurred some expenses towards hospitalization and medical treatment, this Court is of the opinion that the present application can be partly allowed. 4.

Accordingly, the application is partly allowed. 5.

Applicant / respondent No.1 is permitted to withdraw amount of Rs.2,00,000/- (Rs. Two Lakh) from the amount deposited by the petitioner in this Court.

List the writ petition for final disposal after four weeks. 8.

Application is disposed of.
