The present application is filed by the applicant for grant of bail under Section 439 of the Code of Criminal Procedure. The facts on record shows that the death of the deceased who is the wife of the applicant is caused in a matrimonial house within one year of the marriage. The death is due to the throttling. Considering the investigation material, Court has shown the disinclination to grant bail. At this stage, learned Counsel Mr. Paliwal submitted that he be permitted to withdraw the application with liberty to file fresh in change in circumstances. He further requested that the trial Court be directed to expedite the trial. 2.

Permission is granted to withdraw the application with liberty to file afresh under change in circumstances. The trial is expedited. The Trial Court
