Heard Shri Thote, learned counsel for the petitioner, Shri Palshikar, learned AGP for respondent Nos. 1 & 3 and Shri Jagtap, learned counsel for respondent No.2. Perused the reply affidavit.

Prima facie, it appears that the dispute is about computation.

According to Shri Thote, learned counsel, 75% amount of compensation to which the petitioner is entitled, works out to Rs.4,33,176/- while the amount paid to him is only Rs.3,24,017/-. He also adds that the amount of Rs.2,90,000/- in lieu of employment has not been paid and its non-payment has not been explained in the reply. In this situation, we direct the petitioner to appear before Respondent No. 1 on 04.04.2016 and explain the correct calculations.

Respondent No. 1 shall examine the same with the assistance of Land Acquisition Officer and also find out why the amount in lieu of employment has not been paid. This exercise shall be completed within next four weeks.

0703wp4299.15 The benefits to which the petitioner is found entitled, shall be released in his favour within next six weeks. The acceptance of this amount shall not preclude the petitioner from challenging the correctness of the exercise undertaken.

With these directions and keeping all rival contentions open, we dispose of the present petition. No order as to costs.
