The co-accused, rather the main accused namely Shewta Raut has been protected by this Court by an order dated 13.08.2021 passed in Criminal Application No. 377/2021.

This Court in said order discussed in detail about the entitlement of grant of interim protection to co-accused Shewta. Rather for overwhelming reasons, this Court has expressed that it is a fit case to protect her personal liberty.

Order 2309aba438.21 accused, having minor role, is certainly entitled for grant of pre-arrest protection. I do not deem it necessary to assign reasons, since detailed reasons are already assigned while deciding bail application of coaccused in Criminal Application No.377/2021. Suffice to say that this is a fit case to exercise jurisdiction under Section 438 of the Code of Criminal Procedure. Hence, the following order.

(i) Criminal Application is allowed and disposed of.

(ii) The ad-interim order dated 17.07.2021, passed by this Court is hereby made absolute on same terms and conditions, with a modification that instead of attending the police station on every Sunday, as directed earlier, the applicant shall henceforth attend the police station as and when called.
