IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

WRIT PETITION NO. 3541 OF 2015 Sayyad Abid Ali Sayyad Jalal -vsState of Maharashtra, thr.its Secretary, Dept.of Higher Education and others ------------------------------------------------------------------------------------------------------------------------------------ Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders.

or directions and Registrar's orders.

------------------------------------------------------------------------------------------------------------------------------------ Mr. S.W.Sambre, counsel for the petitioner.

Mr. N.S.Rao, AGP for the respondent Nos.1 and 2. CORAM : SMT. VASANTI A. NAIK & PRASANNA. B. VARALE, JJ.

DATE : 24.11.2015.

By this petition, the petitioner has impugned the order of the State Government, dated 09/01/2015 rejecting the prayer of the petitioner for relaxation of age for appointment on the post of clerk.

According to the petitioner, though this Court had by the judgment dated 12/12/2013 in Writ Petition No.5265 of 2012 directed the State Government to sympathetically consider the case of the petitioner for relaxation of age, the respondents have not considered it sympathetically and have only tested the same legally. A statement was made by the learned Assistant Government Pleader on the previous date of hearing, i.e. on 05/10/2015 and the learned Assistant Government Pleader also states today on instructions that the State Government would consider the proposal of the petitioner sympathetically and the impugned order dated 09/01/2015 would not come in the way of the petitioner while deciding the proposal. It is stated that the proposal of the petitioner would be decided within a period of two months.

wp3541.15 2/2 By accepting the statement made on behalf of the learned Assistant Government Pleader on instructions from the State Government, we dispose of the writ petition with no order as to costs.
