CORAM : M.S. Sanklecha & Manish Pitale, JJ.
DATED : June 08, 2017.
This application seeks a condonation of 110 days delay in filing an appeal under Section 260A of the Income Tax Act, 1961 from the order dated 02.09.2016 passed by the Income Tax Appellate Tribunal.
The last date for filing an appeal was 18.01.2017 as the impugned order dated 02.09.2016 of the Tribunal was received on 20.09.2016. The applicant is a Co-operative Bank and due to demonetization policy introduced by the Union of India with effect from 08.11.2016, the personnel of the Bank were involved in coping with the heavy rush at the Bank for exchange/deposit of notes upto 31.12.2016. Thereafter the personnel of the Bank were involved in complying with the various requirements under the demonetization policy and in view of the above preoccupation, the appeal remained to be filed.
We are satisfied with the reasons set out in the application and allow the application in terms of
CAT15-17.odt prayer (a). Application is disposed of accordingly. JUDGE JUDGE halwai
