Heard learned counsel for the parties.

2] In this case, there are already orders for premature release of the petitioner on completing 14 years of actual imprisonment and 26 years of total imprisonment with remission. In terms of the same, the petitioner is expected to be released by 22/08/2022.

3] The learned counsel for the petitioner has relied upon certain Government Resolutions to point out the procedure to be followed in case of aged persons suffering ailments. Even the said Government Resolution applies to male prisoners, who have crossed the age of 65 years. The petitioner is due to attend the age of 65 years on 22/08/2022, which is the date of his probable release as well.

38-WP-513-2021 4] Having regard to the aforesaid, we think that no further release can be granted to the petitioner.

5] Accordingly, this petition is disposed of.

There shall be no order for costs.

6] We thank Mr. Thakre, learned counsel appointed under the legal aid scheme, appearing on behalf of the petitioner. The fees shall be payable to him in terms of the Rules.
