Considering the facts of the case, the complainant (mother of deceased) is permitted to assist the prosecution. The criminal application is allowed. CRIMINAL APPLICATION (ABA) NO.275/2017 Heard.

The applicant, apprehending arrest in connection with crime registered against him and his parents for offence punishable under Section 306 of the Indian Penal Code, has sought pre-arrest bail. The accusations against the applicant are that he was not treating deceased properly and was in habit

2 aba275.17 of consuming liquor and demanding money from the deceased. The facts on record show that the deceased was working as Branch Manager in Central Bank of India, Nagpur and the applicant is not doing anything. The application is opposed on the ground that the deceased has committed suicide within 3 years of marriage and the incident has taken place at the house, where applicant and deceased had been residing. The investigating agency insists for custodial interrogation of the applicant.

This Court has granted protection to the applicant by order passed on 21st April, 2017 directing the applicant to attend police station and co-operate with the investigating agency. The investigating agency has not complained that the applicant has not co-operated with it.

Considering the facts of the case and nature of accusations against the applicant, the order passed by this Court on 21st April, 2017 granting protection to the applicant is confirmed.

The application is allowed in the above terms. JUDGE Tambaskar.
