DATED : APRIL 23, 2019 Heard Mr. D. S. Lambat, learned counsel for the applicants. This is an application for extension of four weeks time to surrender before the trial Court. This Court had on 31.01.2019, dismissed the appeal filed on behalf of the applicants. Though, the appeal was dismissed on 31.01.2019, in view of the fact that during the course of appeal, the appellants/applicants were on bail, six weeks time was granted to them to surrender before the trial Court to undergo the sentence, failing which the trial Court was directed to take appropriate steps to procure their presence for serving out the jail sentence.

The applicants did not surrender within the time as granted vide order dated 31.01.2019. They filed the application on 20.03.2019 for extension of time vide Criminal Application No.320/2019 and this Court (Coram: Mrs. Swapna Joshi, J.) on 25.03.2019 granted two weeks

appa420.19.odt time to the applicants to surrender before the trial Court. Even in that extended period, the applicants did not surrender and filed this application for further extension of four weeks.

Though, there might be reasons, however, that cannot be considered since the time was already granted. Even according to the applicants, they have already filed an appeal before the Hon'ble Apex Court. The applicants could have obtained appropriate orders from the Hon'ble Apex Court.

In that view of the matter, the application is rejected.
