In fact, the challenge in the present matter is to the order passed by the Additional Sessions Judge, Akola dated 9th June, 2009 thereby partly allowing Revision No.159 of 2009 then preferred by present respondent No.2 Gorakshan Sansthan, Akola. The said earlier revision before the Sessions Court was for challenging the order passed by Judicial Magistrate First Class, Court No.1 Akola, dated 1st June, 2009.

In fact, the present revision can be viewed as an application under Section 482 of the Code of Criminal Procedure. Whatever it may be, as none present for the revision-petitioner and as the matter is pending since 2009 and earlier dismissed for default and as the challenge is to the interim order passed by Judicial Magistrate First Class and altered by the first revisional Court regarding custody of the animals i.e. cows and as the original criminal case is still

2 revn119.09 pending before the trial Court and apparently stayed due to these proceedings, present proceeding is dismissed for want of prosecution and is accordingly disposed of. (A.R.JOSHI, J) RRaut..
